55 Years On: How Nigeria’s Independence, Military Crippled Indigenous Politics

Editor’s note: In the fifty-five years of Nigeria’s political emancipation, many analysts have put divergent opinions forward to X-ray the nation’s performance in terms of political aspirations. At this point, it is highly imperative to evaluate how Nigeria has fared since 1960. Eustace Dunn, Naij.com’s senior editor, in this opinion article makes an analysis of how Nigeria’s independence, military and indigenous politicians destroyed her political system from the cradle.

Nigeria

Just like other African countries and some first-world countries, Nigeria is a by-product of political artificiality which has to a very large extent jeopardized the system of government and political activities culminating from cultural, religious, geopolitical and categorical diversities.

A brief reminiscence of the eventual independence

Retrospectively, the motion for Nigeria’s independence had first been proposed by a foremost anti-colonial and pro-democracy activist, Anthony Enahoro, who died about five years ago. When a neighbouring country, Ghana, was declared free in March 6, 1957, the likes of S.L. Akintola, Remi Fani-Kayode and Tafawa Balewa pressed further, hence the declaration in 1960.

In a ceremony that climaxed into the night of September 30, 1960, the British anthem, which was sung for the very last time, immediately ushered in the Nigerian national anthem for the first time at twelve midnight the next day, urging all compatriots to rise and celebrate the nation’s emancipation from colonialism.

Britain kept its own side of the bargain to grant the nation political autonomy. Thus, October 1 became the most significant day in the history of Nigerian politics, admitting the country into the league of independent nations.

At this point, many Nigerians saw the political freedom from the colonial masters as an escape route from the shackles of injustices and chains of discrimination with the hope that the country will grow rapidly politically, considering the fact that the country was now under indigenous control.

How elites bedeviled the political autonomy

Some elites had then pointed from a predictive judgement that the nation was not yet ripe in terms of political, economic and socio-cultural development to be able to take care of itself as greed and political domineeringness were lurking around the corner.

To a great mortification, the projection that the autonomous political adventure may be abrogated by these same indigenous bigwigs came to pass at the very juvenile stage of its inception. Greed came from the discovery of oil followed by parliamentary naivety which came from political desperations and power tussle.

Political elites became owners of oil wells to enrich their personal pockets. One of the greatest natural resources that was supposed to be blessing to the nation exacerbated the existence of Nigeria and oneness of her people.

Eventually, lawlessness, regional hostility and political instability at the early point of the nation’s parliamentary democracy paved way for military takeover six years later. A system that seemed to be bad became worse than ever as the men in uniform and boot swept off every corner of leadership into absolute military rule.

This reprehensible acquisitiveness and insatiable desire for wealth and power made four military power dogfight happen within a period of ten years. From Aguiyi Ironsi to Yakubu Gowon, Murtala Mohammed and Olusegun Obasanjo, Nigeria became politically dead and militarily awakened.

Suffice it to say that the same “prebendalism” which saturated the Nigerian political, nay, military rule also motivated one man, the late Odimegwu Ojukwu, to make a proposition for secession to form a republic of Biafra which never saw the light of day. This attempt to withdraw from an alliance with Nigeria was another impetuous move that finally stultified the nation’s economic, socio-cultural, political and geographical existence. Many died in the process. It became a history that created an indelible mark in the hearts of mostly those from eastern part of Nigeria with many men of great pen putting pen to paper to tell various sides of the civil war that lasted from 1967 to 1970.

The military created a sub-national ethnic gap which led to the civil war. The war crystallizes the leadership challenge as regards political development and stability. The identity-based civil war, just like the Chechneyan conflict in Russia (1994), made Nigeria contend with this cleavage which undermined the legitimacy of the citizenry (who becomes Biafran and Nigerian) and national integration.

Nigeria was indeed not ripe for the independence which Herbert Macaulay fought for as the country’s case still offers a cautionary tale of the excesses of military rule bolstered by extreme oppression, force, ethnic favouritism and discrimination.

How independence crippled ethnic unity and national development

The concept of nationalism was hinged on a concrete definition as a patriotic feeling which brings an oppressed but related people together to demand for freedom. It is a core devotion to one’s nation and the consciousness that brings about the idea of co-existence. It is the loyalty and the spirit of togetherness geared towards promoting national culture and interest as against those of the oppressors.

When the movement succeeded in achieving these goals, the same greed shattered every effort injected prior to the emancipation. People became loyal to regions instead of the defined nation. Militias sprang up into sectional violent militant group to agitate for a freedom out of the freedom already given.

The independence opened the eyes of people to actually see that even though the Northern and Southern protectorates were amalgamated, they were different people. That is why an Igbo man had to come up with the idea that he was a Biafran.

If everyone who clinched on political power observed this national unity and development instead of embezzlements and personal gratification, Nigeria would have been a world tourist centre. Right from the inception of indigenous government, everything spoilt. Independence paved way for the scramble for wealth by predator elites who dominated the political scene. From the Nnamdi Azikiwes of this world to the Tafawa Balewas and the likes, exploitation and corruption gained their taproots. The worse became when the military now decided to grant power to democratically elected president in 1979, Shehu Shagari. By this time, the ideology of nationalism was thrown into the trash.

During this period, the political system was not able to accommodate diversity in the task of national governance. It is on record that the legacy which Britain left, coupled with the military junta and the divergent populace, led to a great challenge in the Shagari-led administration. However, in a bid to redress this, Muhammadu Buhari came in with his fight against corruption and ended up violating human rights.

Ibrahim Babangida and Sani Abacha milked the nation to a standstill. The unpronounced stealing was the less than a year period of Abdulsalami Abubakar. All these happened as a result of selfish interest in the nation’s treasury. And this is how independence crippled Nigerian politics.

Monetization of political offices at the expense of democracy

Big political players have shown over the years that democracy has no other plans than one: to serve the interests of the selected few who continually have their way at the expense of the collective will and interests of the people. In this democratic dispensation, the legislative arm has successfully turned the hallowed chambers to money-making venture.

The National Assembly has a lot of senators, and House of Representatives’ has a lot of members who have been there for years without at least proposing a motion or a bill. All they do is wait for allowance. It is this money factor that shows that, when investigations are embarked on, money changes hands and the case gets closed.

This “prebendalism” brought the concept of democracy being a government of the people, for the people and by the people, to zero functionality.

Independence of a nation can only work when its people expunge self-enrichment and hatred for one another based simply on the fact that the people are of different ethnicity. Democracy can only work when there are the right people to help uphold its essence.

At fifty-five years, Nigeria has come a long way with a lot of promises from presidents, especially since 1999, and failures to fulfill such pacts. Achieving democratic stability could take up to a century or more. There is no sign as to whether the country will get there any time soon.

Nigerian leaders are hereby admonished to wholeheartedly embrace the features of integrity, probity and high standard of self-discipline as expected by the citizenry. They, as a matter of fact, must be saturated in national patriotism and neutrality in order to have firm grip of the development of Nigeria and also better the lots of all.

Nigerians demand credible, responsible and people-oriented leadership. The citizenry will be relaxed if the leaders do away with old habits of corrupt practices which over time impeded the nation from getting to the list of developed nations. When this is done, Nigeria will be a better place.

According to the recommendations, the PDP should choose a northern candidate for the next presidential election in Nigeria. Besides that, it is recommended to pick up the best candidate for the next presidential race, using a procedure of direct primaries.

The committee chairman, Ike Ekweremadu, disclosed the PDP’s plans in Abuja on Wednesday. He told that “it is recommended to the party to strictly apply the zoning principle at all levels,” adding that “in particular, since the last President of PDP extraction came from the southern part of Nigeria, it is recommended that PDP’s presidential candidate in the 2019 general elections should come from the northern part of the country.”

The acting national chairman chairman of PDP, Uche Secondus responding to the recommendations told that “we agree that the presidential candidate of our party will come from the North.”

Five months ago the former national chairman of the Peoples Democratic Party (PDP), Alhaji Bamanga Tukur, has stated why the party lost miserably at the 2015 general elections.

According to Tukur, the defeat of the party at the hands of the All Progressives Congress (APC) during the March 28 and April 11 general elections was a failure on the part of the leadership to listen to his warning about the looming defeat.

At the same time Dr. Babangida Aliyu, said the recent defeat of the Peoples Democratic Party at both national and state elections did not come to Nigerians as a surprise because “we saw it coming.”

“Yet, across the world, 31 million girls of primary school age and 32 million girls of lower secondary school age are out of school, with sub-Saharan Africa suffering the lowest proportion of countries with gender parity in education.

The Chief of Army Staff, Lt.-Gen. Tukur Buratai, has restated the military’s commitment to end the activities of the deadly Boko Haram sect.

According to him, the military was determined to meet the set deadline of defeating the insurgents by December, NAN reports.

This was announced in a statement issued in Abuja on Wednesday, September 30 by Col. Sani Usman, the acting director of army public relations.

The statement read: “I want to reassure Nigerians that Nigerian Army is ever determined to succeed in meeting up with the set deadline of defeating Boko Haram terrorists by the end of this year.”

Saraki Attackers Arraigned Before The Law

Eight persons have been arraigned before a magistrate court in Ilorin for disturbing the peace at the Muslim praying ground on sallah day.

The Senate president, Bukola Saraki was the victim of an attack by some person on Thursday, September 24 during the Eid Il Kabir prayer session.

Days before the celebration, Esosa Amadasun, the commissioner of police in the state had announced the deployment of 2,000 police officers to praying grounds after a ploy to attack politicians in the state was uncovered.

The security plan seemed to have been unsuccessful as it was reported that the senate president was pelted with stones and sachet water when he arrived at the prayer ground. The police however arrested eight persons in connection to the attack. They are: Aliyu Immam, 24, Sheu Ibrahim, 23, AbdulKadri Sharafadeen, 25, Yusuf Olayinka, 26, Mohammed Abiola, 27, Ayo Giwa, 65, Zakariyau Abubakar, 50, and Kareem Ajape, 35.

News Agency of Nigeria reports that the suspects are facing a charge of disturbing religious assembly which is contrary to the penal code law.

Insp. Nasiru Yusuf, the prosecutor, said the accused persons disturbed the peace of the religious assembly by attacking the very important persons in the state. He urged the court to remand the accused persons in prison pending the outcome of an investigation that was going on.

After the accused persons pleaded not guilty, the magistrate, Mercy Adebola, granted them bail for N100, 000 with two sureties each. The case was adjourned to Monday, October 12.

Bukola Saraki has however denied that he was specifically targeted in the attack and has urged Nigerians to stand by him in support.

Reps mandate Speaker to meet Buhari over Saraki’s trial

In what seem to an interesting political development, the leadership of the House of Representatives is set to meet President Muhamadu Buhari over the perceived travails of the President of the Senate, Bukola Saraki, who is currently standing trial before the Code of Conduct Tribunal.

The decision of the House followed a motion brought before the House under matters of urgent Public Importance by a member, Hon. Raphael Igbokwe with the title: “a motion on Nigeria’s 55 years of independence: need for vigilance.”

The President recently said he has no hand in the trial of Saraki who is facing a 13-count charge, bordering on corruption and false assets declaration before the Code of Conduct tribunal, and that the case will run its course .

The lawmakers in their resolution passed “a vote of confidence on the leadership the National Assembly, urged all institutions of government to be guided by the rule of law and due process and avoid being used to undermine any arm of government.”

Sequel to an amendment by the Minority Leader, Leo Ogor, and Hon. Patrick Asadu, members at plenary yesterday mandated the leadership of the House to meet with the President ” with a view to politically resolve all outstanding issues relating to National Assembly in the interest of Nigerians”

His amendment to the original motion, which was also granted included mandating the Speaker “to intervene in the issues and challenges being faced by the Chairman of the National Assembly ( Saraki) with a view to finding a political solution and protecting the institution of the National Assembly as a whole for the interest of our democracy.”

Members while congratulating Nigerians on the 55 years of independence, urged Nigerians to continue to live in peace, harmony and charity to one another.

What Boko Haram Members Did To Water Sources In Villages Attacked Is Totally Shocking

Boko Haram members who are being frustrated from the villages which they had captured, have resorted to new ways of making life unbearable for the villagers.

According to a press release issued by Colonel Tukur Gusau, Deputy Director Army Public Relations, the insurgents have taken to poisoning of water sources like wells and streams in the places where they had been dislodged by the Nigerian troops as a way of taking revenge for their defeat.

The statement read:

Information reaching the Theatre Command, OPERATION LAFIYA DOLE indicates that Boko Haram terrorists have now resorted to poisoning water sources like wells and streams in areas they were dislodged by gallant troops or areas threatened by offensive operations.

The latest being the poisoning of the cattle water ponds in KANGALLAM village along MARTE and ABADAM axis in Borno State where a large number of cattle died after drinking water from the ponds. Credible information available to the Theatre Command indicates that though no human life was lost as a result of the barbaric act of the terrorists, however, some cattle were killed after drinking water from some poisoned sources.

The action of the terrorists is no doubt aimed at taking their own pound of flesh on the innocent citizens and livestock as a result of the unbearable offensive operations through the combined effort of the Nigerian Army and the Nigerian Air Force to route them out completely from their enclaves and hide-outs all over the North East.

In view of this development citizens are called upon to avoid as much as possible drinking water from unverified sources especially in locations that troops routed out Boko Haram terrorists.

It was also recently gathered that the insurgents make use of fake National Identity Cards to penetrate countries where they want to perpetrate their despicable acts.

Drama in Senate over absence of ministerial list

A mild drama played out on the floor of the Senate over the absence of the much awaited ministerial nominees’ list on Wednesday.

The Senate gallery was unusually crowded by people who thought that the ministerial list would be read by Senate President, Bukola Saraki.

The drama was sparked by the outburst of the Senate Minority Leader, Senator Godswill Akpabio.

The Senate President had hardly concluded reading a letter from the South West Senate caucus which nominated and endorsed Senator Olusola Adeyeye (Osun Central) as Senate Chief Whip when Akpabio sought and was granted the leave to speak.

Akpabio started by thanking President Muhammadu Buhari and Vice President Yemi Osinbajo for calling to sympathize with him over the auto crash he was involved in last month in Abuja.

He said the newspapers, television stations and other media outlets were awash with the news that the ministerial list had been sent to the Senate.

He added that President Buhari promised that the list would be submitted to the Senate in September.

He noted that most Nigerians were also concerned that submission of the list had been unduly delayed.

He said, “Mr. President, today is September 30th. Where is the ministerial list. I am surprised that the list is not part of what was read by Mr. Senate President.”

Before Saraki could respond, Deputy Senate Leader, Senator Bala Ibn Na’Allah, took the floor.

Na’Allah (APC Kebbi South) stood in for Senate Leader, Mohammed Ali Ndume, who was not in the chamber.

He noted that since the question Akpabio raised had to do with the All Progressives Party (APC) government, it was his duty to respond.

Na’Allah said that it was still too early for anybody to conclude that the ministerial list would not be submitted on Wednesday.

The Deputy Senate Leader said he was aware that the office of the Senate President remains open till 12 midnight every day.

He insisted that the ministerial list could still be submitted to the Senate especially when September 30th ends at 12 midnight on Wednesday.

He said, “11.59pm up to 12midnight is still September 30th. The day is still very young. The ministerial list can still be submitted. So there is no cause for alarm.”

Na’Allah’s response drew wild laughter from Senators on both sides of the divide. Some were gesturing to pat Na’Allah on the back.

Saraki said that based on the explanation of Na’Allah, he has no option than to rule Akpabio out of order.

There was further laughter in the chamber.

Sylva wins Bayelsa APC governorship ticket

Former Governor of Bayelsa State, Chief Timipre Sylva, has emerged as the candidate of the All Progressive Congress (APC) for the December 5 governorship election in the state after winning the party’s primary.

Sylva polled 981 votes to defeat his distant rival, Mr. Godknows Powell, who scored 39 votes in a peaceful primary conducted at the state secretariat of the party in Yenagoa by a seven-member Electoral Panel led by Brig-Gen. Mansur Dan Ali (retd).

A former two-time member of the House of Representatives, Mr. Warman Ogoriba scored 28 votes; Diekivie Ikiogha, 22; Ebite Williams 9; Charity Valdego 7; Preye Aganaba 8 and Febo Austin 7.

Others are Romeo Dekeye 10 votes; Ebitimi Amgbare 3; Ambassador Otiotio 1, Felix Oboro 1 and Christopher Enai 2.

Out of 1147 votes cast at the poll, the chairman of the panel declared 1, 120 votes valid and invalidated 27 votes.

The internal election was peaceful and largely devoid of rancour and violence which characterized the initial exercise that was held on September 22 at the Sports Complex.

Delegates conducted themselves orderly and waited patiently from 11pm on Tuesday till Wednesday afternoon when they cast their votes after accreditation.

There was, however, a brief protest at the venue of the election when Ikiogha led some aggrieved aspirants to the area accusing the panel of shutting them out of the exercise.

For about an hour, Ikiogha, Prof. Tarila Tebepah, Pastor Apirila Tonye and Austin Ogiohwon kept the panel chairman busy with their complaints.

Ikiogha said the panel arrived the state without meeting with them to intimate them on the modalities for the election alleging that the committee came with a mandate to stop them from partaking in the exercise.

“This election is worse than the previous exercise that was cancelled. We are aware that a new list of delegates was compiled the previous night for the purpose of the election. This is not the change we advocated for. We are appealing for the cancellation of the election”, he said.

But the committee chairman insisted that the process was transparent and appealed to the aggrieved aspirants to maintain the peace.

After lodging their complaints, the angry aspirants walked out of the venue of the exercise and refused to come back till the end of the election.

Speaking shortly after he was declared the winner of the poll by the chairman, Sylva said the victory only signaled the need for members of the party to close ranks and work harder to win the December 5 election.

He congratulated the former Managing Director, Niger Delta Development Commission (NDDC), Chief Timi Alaibe, for withdrawing from the race and demanded his support and cooperation of other aspirants ahead of the general election.

The APC candidate commended security agents who stayed awake to maintain the peace throughout the exercise.

OPINION: Tinubu And El-Rufai In A Plot Against Bukola Saraki

Editor’s note: Kuddi Haastrup, Naij.com guest contributor from Lagos, suggests that the ordeal Bukola Saraki, the president of the Nigerian Senate, is currenrly faced with might be the result of a sophisticated plot masterminded by the two big wheels of the Nigerian politics – Bola Tinubu and Nasir El-Rufai – aiming at grasping a bigger part of the “Nigerian pie” in 2019.

Saraki makes headlines

Those keenly watching the ongoing travails of Abubakar Bukola Saraki, the Nigerian Senate president, in the net of the Code of Conduct Tribunal (CCT) must have noticed that a number of media outlets have been at the forefront of the campaign to sway the tide of Saraki’s ordeal in an unfavourable for him direction. Additionally, the recent allegations seem to suggest that these media outlets are under the control of the ruling party. These forces, who have shown that they are bent on deciding who gets punished, who gets favoured, and who gets sidelined in this administration, have focused all their attention on Saraki since his became the Senate president on June 9, 2015.

Week in and week out, day in and day out, the media seem to be working round the clock to embarrass Saraki at all costs, amplifying stories beyond reasoning, corrupting the truth, and even fabricating documents. One of the recent examples is the passport saga, when the United Kingdom Home Office had to interfere and declare that the passport was a forgery.

The masterminds

For those possessing the political savvy it is clear that the anti-Saraki attacks have 2019 connotations, as both Bola Ahmed Tinubu and Mallam Nasir El-Rufai are reportedly intending to vie for the highest seat in the country. It is for this reason that the aforementioned APC powerhouses have come together to take out a prospective threat in the form of Bukola Saraki, who is considered a force to reckon with as the head of the Nigerian legislature, a former chairman of the Nigerian Governors’ Forum and a former governor.

While Tinubu has been jostling for the control over the ruling party by swaying decisions through his loyalists and using his media power to influence the public opinion, El-Rufai, who is now considered the de-facto vice president of the Federation, has been using his influence in the Buhari’s inner circle to manipulate people to do things in the president’s name. In a nutshell, El-Rufai has reportedly been fingered as the instigator of the plot against Saraki through his former special assistant, Dan Umar (the chairman of the CCT), while Tinubu is said to be the “public opinion influencer”. One has concocted the case, the other sells it to the public.

Smooth operator

As there are no permanent friends or enemies in politics – only permanent interests, the El-Rufai and Tinubu theory inspires confidence. The analysts state that though El-Rufai and Tinubu have similar ambitions, working together now to fight an enemy like Saraki will ultimately make the 2019 race a contest between the two of them. In this scenario, Tinubu might just trade the presidential ticket to El-Rufai, leaving the crafty Mallam at the helm of the nation and settling beside him at the top of the party. He actually did so in 2011, having cut a deal with Goodluck Jonathan that gave him control over the South West. However, he then lost his party in the presidential election.

Finally, haven spoken to some prominent APC members during my recent trip to Abuja, I came to a conclusion that the fight between Tinubu and Saraki is a fight that should concern all Nigerians – as Tinubu is clearly on a mission. Saraki is reportedly said to be against the appointment of Babatunde Fowler, the erstwhile chairman of the Lagos State Internal Revenue Service (LIRS), as the chairman of the Federal Inland Revenue Service (FIRS), because while Fowler administered the LIRS, he hired the Tinubu’s company, Alpha Beta Consultancy, and reportedly paid it 10-15% of the revenue monthly. With Lagos state generating about N30 billion monthly, Tinubu’s company was making at least N3 billion per month – or N36 billion per year.

Barring any last-minute political changes, once confirmed as the FIRS boss, Tinubu will expectedly use “Tunde-the-Taxmaster” Fowler as the “siphon agent” to finance his election in the same manner they did in Lagos state. At the juncture, Fowler’s ambitions and Tinubu’s persistent presidential mission stand very germane. Then, if we all understand how the thirst for power flames like, we will all agree that Saraki is not worth “sparing” at all, as he is just too strong an impediment to all these missions and ambitions.

OPINION: Tinubu And El-Rufai In A Plot Against Bukola Saraki

2019: PDP zones presidency to North

The leadership of the Peoples Democratic Party (PDP) has zoned its 2019 presidential ticket to the North. The party, however, did not state which of the three zones in the region will take the ticket.

The party’s Acting National Chairman, Prince Uche Secondus, made the disclosure at the party secretariat on Wednesday while receiving the report of the Post-Election Review Committee.

Secondus said the decision was part of the recommendations of the committee, chaired by the Deputy President of the Senate, Ike Ekweremadu.

He described the report as a turning point in the fortune of the party, saying the PDP is well organised and ready to play the role of vibrant opposition.

The party chairman said the report of the committee would be presented before other organs of the party for adoption and ratification.

Ekweremadu had, while presenting the report, stressed the need for the party to strictly adhere to the zoning principle at the local, state and national levels.

He said, “Since the last president of PDP extraction came from the southern part of Nigeria, it is recommended that PDP’s presidential candidate in the 2019 presidential election should come from the northern part of the country.

“This is in accordance with popular views expressed in the submissions to the committee. This will also assuage ill feelings in the north over any perceived breach of the party’s zoning principle.

The committee also recommended that the title of “party leader” be discarded forthwith at all levels, as it has no basis in the constitution of the PDP, adding that this would go a long way to strengthen the structure of the party at all levels.

Similarly, the committee also recommended that the party do away with the use of delegates for picking its candidates for elections, saying the process had been grossly compromised and abused.

Instead, it recommended the adoption of direct primaries as means of electing candidates for elections at all levels. This, according to the report, was a practical way of returning the party to the people.

“On this note therefore, we expect those around our dear President to be cautious and desist from actions and utterances that tend to set him up for public ridicule,” the party stressed.

According to the press statement published on the party’s website, the citizens of the country were congratulated for keeping faith in ‘project Nigeria’ and working together in building a strong nation.

Nigerians were obliged to use the anniversary to recommit to respecting their leaders at the local government, state and national levels while paying adequate reverence to national symbols and institutions.

The party said: “The occasion reminds of Nigeria’s common root and destiny as well as her resilience and determination to succeed in all spheres of life as a strong, united and prosperous nation, irrespective of her challenges.”

In wishing the government and people of Nigeria, happy independence, the leadership of the PDP prayed for abiding peace in the country.

Meanwhile, the PDP has criticised President Muhammadu Buhari for his failure to meet up with his promise to submit the nominees for his cabinet to the Nigerian Senate as promised.

Judge withdraws from Saraki’s suit against CCT, others

Justice Ahmed Ramat Mohammed of the Federal High Court, Abuja, on Wednesday withdrew from a case filed by Senate President, Bukola Saraki, against the Code of Conduct Tribunal (CCT).

Saraki is seeking to retrain the CCT, the Federal Ministry of Justice and others from proceeding with his trial on alleged false declaration of assets.

Justice Mohammed had on September 17 declined to grant Saraki’s prayer for an order of interim injunction restraining the respondents.

Instead, the judge ordered that the respondents be put on notice and for them to explain on September 21, why the prayer sought by Saraki should not be granted.

On September 21, the judge, after entertaining argument from parties, elected to hear the substantive suit.

Justice Mohammed said it was more honourable for him to hand the case file back to the court’s Chief Judge for reassignment to another judge.

To avert a possible misrepresentation of the day’s proceedings, the judge directed an official of the court to make printed record of the proceedings, signed by the judge, available.

Court sanctions NDLEA for stalling Kashamu’s suit

Justice Ibrahim Buba of the Federal High Court in Lagos on Wednesday sanctioned the National Drug Law Enforcement Agency (NDLEA) for delaying hearing in a suit brought by Senator Buruji Kashamu.

The Senator representing Ogun East Senatorial District is seeking to restrain the Federal Government from seizing his assets.

NDLEA, a respondent in the action, had asked the judge to disqualify himself from adjudicating the suit.

The agency also prayed the court to discharge an order restraining it from arresting Kashamu.

The suit was adjourned for hearing on Wednesday, but NDLEA’s lawyer, Mr. J.N. Sunday, sought an adjournment to enable him regularise his processes.

He said there were “blunders” in the agency’s application before the court that needed to be corrected.

Kashamu’s lawyer, Ifeoma Esom, who stood in for Ajibola Oluyede, said they were ready to go on with the case as the suit was ripe for hearing.

Sunday, however, said the agency did not intend to delay the case by seeking an adjournment.

“The applicant has already tied our hands with the order. We have no reason to delay this matter,” he said.

Justice Buba awarded N20,000 cost against NDLEA, and adjourned to enable it rectify the “blunders in their processes.”

The judge awarded the cost in favour of Kashamu without being prompted, as Esom did not ask for compensation for inconveniences occasioned by the adjournment.

Justice Buba also pointed out that NDLEA appeared to be asking for two contradictory reliefs.

The government said the new outbreak which has been reported in Lagos, Ogun, Rivers, Oyo, Enugu, Abia and the FCT, occurred between July and last month.

The Permanent Secretary, Federal. Ministry of Agriculture and Rural Development, Sonny Echono, who spoke at a meeting with stakeholders in the poultry industry, said that 491 farmers have been affected by the disease.

Taraba tribunal sacks Senator Marafa

The Taraba State election petition tribunal sitting in Jalingo –the state capital yesterday sacked Senator Bashir Marafa who is representing Central Taraba district.
The tribunal declared the senatorial candidate of the All Progressives Congress (APC) Yusuf Abubakar Yusuf as winner of the 2015 Central Taraba election.
Delivering judgment on the petition filed by Yusuf, the three man panel unanimously agreed that Marafa of the PDP was not the actual winner of the election which took place on March 28.
Chairman of the tribunal Justice Samson Angor ruled that the litigant was able to successfully prove that the first respondent (Marafa) was not actually elected by the majority of the electorate.
The tribunal observed that the dispute in the case was on the way and manner the results were collated and not on the conduct of the election.
The tribunal said the votes in the election were swapped in favour of the PDP candidate. It added that the APC candidate would have triumphed in the election had the collation of results were properly and effectively done.
The tribunal gave the final result of the Central Taraba senatorial election as: APC-66,097 votes, LP-455, PDP-64,356, PDP-64,356 and SDP-33,489 votes.
The tribunal panel ordered the Independent National Electoral Commission (INEC) to urgently issue the Certificate of Return to the APC’s Yusuf and retrieve the one earlier given to Senator Marafa.
“The petitioner scored the highest number of votes as against that of the first respondent (PDP candidate) who was declared senator for the zone.
“The evidence presented by the petitioner’s lawyer clearly shows that votes were swapped and the results were not entered appropriately.”
“The earlier declaration by INEC in favour of the first respondent should be set aside,” said Ibrahim Yusuf, another member of the tribunal.
Counsel to the sacked senator, Yusufu Akirikwen said his client will appeal the ruling.
Taraba State Chairman of APC, Jika Hassan Ardo applauded the judgment. He said: “Justice delayed is not justice denied. Justice has been done. The judiciary has once again demonstrated that it is the last hope of the common man.”
